HOCL, as a  Govt. of India Enterprise under the Department of Chemicals and Petrochemicals, has taken measures to provide information to the citizens of the country in accordance with The Right to Information Act,2005 (Act). Information as required to be published under Section 4 (1)(b) of the Act is available on the various pages of this website of HOCL.

II. Powers and duties of officers and employees

The officials of HOCL have well defined powers depending upon the levels in which they function. The duties are assigned from time to time by the Unit in charge or Chairman and Managing Director.


III. Procedure followed in the decision making process.

HOCL is a company managed by its Board of Directors. HOCL is constituted under the Company's Act and Directors of HOCL are appointed by President of India consisting of Govt. of India Nominees, independent Directors and Functional Directors. The day-to-day activities of HOCL are managed under the leadership of the Chairman & Managing Director, who is assisted by the Executive Director and Functional Heads of the respective Departments.

HOCL holds various commercial and technical information relating to the business operations of the company and information relating to its employees.


VII. Particulars of any arrangement that exists for consultation with, or reorientation by, the members of the public in relation to formulation of its policy or implementation thereof.

HOCL being a commercial organization, its policies relate to efficiently managing its operations to be able to face the global competition and, hence, there is no arrangement for consultation with members of the public. Its policies are formulated in compliance with the law of the land, guidelines of the government, administrative ministry, Department of Chemicals and petrochemicals, CVC and all other statutory organizations etc. HOCL, however, collects feedbacks from customers and makes changes as required to maintain a high level of customer satisfaction.

VIII. Statement of boards, councils, committees and other bodies consisting of two or more persons constituted as its part or for the purpose of its advice, and as to whether meetings of those boards, councils, committees and other bodies are open to the public, or the minutes of such meetings are accessible for public.

Board of Directors is constituted following the provisions of the Companies Act,1956 consisting of Government of India nominees, independent Directors and Functional Directors. All these Directors are appointed by the President of India. While decision taken or minutes of the meeting of the Board of Directors are not accessible by the public, important decisions regarding the company and/or its management are being communicated to the statutory authorities and others as required under the law from time to time.

IX . Monthly remuneration received by each of company's Officers and employees, including the system of compensation as provided in its Regulations.

The Company has entered into long-term agreements with the Workers' Unions. The Officers are paid Pay-scales as approved by the Board of Directors/Government based on Govt. guidelines.

HOCL follows industrial D.A. Pattern of wages for its executives and workmen.

Besides Basic Pay, employees are entitled to certain benefits like DA, HRA, and other  fixed /variable fringe benefits.

X. Budget allocated to each of company's agency, indicating the particulars of all plans, proposed expenditure and reports on disbursements made.

HOCL prepares annual capital budget for its projects if any and also an annual revenue budget  . These Budgets are approved by the Board of Directors. Expenditure incurred by the company is governed by these budgets.


XI. Particulars of facilities available to citizens for obtaining information, including the working hours of a library or reading room if maintained for public use.

The Company provides information to the citizens through its website and social media (Facebook  and Twitter). Company does not maintain any public library.

A. How to apply
 

Introduction
Any citizen of India who desires to obtain any information under the Right to Information Act-2005 may make a request preferably in writing or through electronic means to the

Public Information Officer/Assistant Public Information Officer of the concerned Office/Unit of the Company.

Hindustan Organic Chemicals Ltd. on receipt of a request shall either provide information within 30 days of the receipt of request on payment of such fees as may be prescribed. Where the decision is taken to provide the information on payment of any further fees representing the cost of providing the information, the Public Information Officer shall send the intimation to the person making the request.


Application Fee
In accordance with directives given in the Gazette notification issued by Deptt. of Personnel & Training, Ministry of Personnel, Public Grievances and Pensions, Govt. of India, vide No.34012/8(s)/2005-Estt.(B) dated16.9.2005, the application for obtaining information under sub-section (1) of Section 6 must be accompanied by prescribed application fee drawn in favour of Hindustan Organic Chemicals Ltd’, payable at the local office where the application has been submitted. At present the application fee, which is subject to change from time to time, is as under:-

Mode of payment
By cash against proper receipt or by demand draft/banker's cheque/ Indian Postal Order. Fee in cash sent by Courier/post etc. shall not be accepted. Court fee stamps are not accepted mode of  application Fees.
Persons who belong to BPL category are not required to pay any fee provided necessary documents are produced in support of their claim.
Note – Applicant can also apply for information under RTI Act through online RTI portal of Government of India.


Additional Fee
In case it is decided to provide the information, the Requester shall be informed of the additional fees required to be deposited by him/her for the information sought and information shall be furnished after deposit of fee by the Requester as per the Act. In accordance to directives given in the above mentioned Gazette notification dated 16.9.2005, for providing the information under sub-section(1) of Section 7 of the Act, an additional fee shall be charged. At present, the applicable rates, which are subject to change from time to time, are given as under:-

  1. For each page (A4 / A3 size) created or copied Rs.2/- per page
  2. For a copy in larger size paper Actual charge or cost price
  3. For samples or models Actual cost or price
  4. For inspection of records No fee for the first hour, and a fee of Rupees five for each 15 minutes (or fraction thereof)

Exemption to certain categories of information from disclosure under Section 8 & 9.
Categories which include-

  1. Information, disclosure of which would prejudicially affect the sovereignty and integrity of India, the security, strategic, scientific or economic interests of the state, relation with foreign state or lead to incitement of an offence.
  2. Information which has been expressly forbidden to be published by any court of law or tribunal or the disclosure of which may constitute contempt of court. Information, the disclosure of which would cause a breach of privilege of Parliament or the State Legislature.
  3. Information including commercial confidence, trade secret or intellectual property, the disclosure of which would harm the competitive position of a third party, unless the competent authority is satisfied that larger public interest warrants the disclosure of such information;
  4. Information received in confidence from foreign Government; information, person or identify the source of information or assistance given in confidence for law enforcement or security purposes;
  5. Information which would impede the process of investigation or apprehension or prosecution of offenders;
  6. Cabinet papers including records of deliberations of the Council of Ministers, Secretaries and other officers;
  7. Information which relates to personal information the disclosures of which has no relationship to any public activity or interest or which would cause unwarranted invasion of the privacy of the individual.

Further, for providing the information under sub-section(5) of Section 7 of the Act, the fee shall be charged at the following rates:-

  1. For information provided in diskette / floppy Rs. 50/- (Rupees Fifty only) per diskette / floppy
  2. For information provided in printed form At the price fixed for such publication or Rs.2/- per page of photocopy for extracts from the publication.

The mode of payment of above mentioned additional fees shall be the same as application fee.


Appeal
In case the Requester who does not receive the decision within the time specified in sub-section(1) or clause (a) of sub-section (3) of Section 7 of the Act, or is aggrieved by a decision of the PIO, as the case may be, may within thirty days from the expiry of such period from the receipt of such a decision, prefer an appeal to the Appellate Authority for redressal of the grievance.
